Lorsqu&rsquo;un v\u00e9hicule a \u00e9t\u00e9 valid\u00e9, inspect\u00e9 et re\u00e7u \u00e0 titre isol\u00e9 par les autorit\u00e9s techniques d&rsquo;un pays membre, cette homologation doit \u00eatre reconnue par les autres \u00c9tats. Elle suspend l&rsquo;instruction et exige une nouvelle proc\u00e9dure de francisation via la DREAL, prenant le contre-pied du principe europ\u00e9en de reconnaissance mutuelle.<\/li>\n  <li><strong>Le recours Minist\u00e9riel [BDC\/2026\/A01\/7416] :<\/strong> Face \u00e0 l&rsquo;inertie des services de l&rsquo;immatriculation, le dossier fait l&rsquo;objet d&rsquo;un recours officiel aupr\u00e8s du Minist\u00e8re de l&rsquo;Int\u00e9rieur sous la r\u00e9f\u00e9rence BDC\/2026\/A01\/7416.<\/li>\n  <li><strong>Le statu quo actuel :<\/strong> Malgr\u00e9 les signalements, l&rsquo;administration fran\u00e7aise persiste dans son refus de r\u00e9ciprocit\u00e9 des RTI, maintenant une immobilisation juridique caract\u00e9ris\u00e9e.<\/li>\n<\/ul>[\/et_pb_text][et_pb_text _builder_version=\u00a0\u00bb4.27.6&Prime; _module_preset=\u00a0\u00bbdefault\u00a0\u00bb text_font_size=\u00a0\u00bb18px\u00a0\u00bb background_layout=\u00a0\u00bbdark\u00a0\u00bb global_colors_info=\u00a0\u00bb{}\u00a0\u00bb]<h2>Le v\u00e9hicule au c\u0153ur du litige ANTS : une immatriculation luxembourgeoise contest\u00e9e<\/h2>\n\n<p><strong>Apr\u00e8s avoir fait l&rsquo;objet d&rsquo;une r\u00e9ception \u00e0 titre isol\u00e9 au Luxembourg, ce v\u00e9hicule a \u00e9t\u00e9 officiellement admis \u00e0 la circulation et immatricul\u00e9 en 2003.<\/strong><\/p>\n\n<p><strong>Pendant plus de dix ann\u00e9es, il a \u00e9t\u00e9 utilis\u00e9 en France comme v\u00e9hicule de r\u00e9sidence secondaire de ses propri\u00e9taires luxembourgeois, sans qu&rsquo;aucune autorit\u00e9 fran\u00e7aise ne remette en cause sa pr\u00e9sence sur le territoire ni sa capacit\u00e9 \u00e0 circuler en toute s\u00e9curit\u00e9.<\/strong><\/p>\n\n<p><strong>Ce n&rsquo;est qu&rsquo;apr\u00e8s sa vente \u00e0 Menton en 2013 \u00e0 un citoyen fran\u00e7ais que les blocages administratifs sont apparus.<\/strong><\/p>\n\n<p><strong>Pourtant, rien n&rsquo;avait chang\u00e9 :<\/strong><\/p>\n\n<ul>\n<li>M\u00eame num\u00e9ro VIN ;<\/li>\n<li>M\u00eame configuration technique ;<\/li>\n<li>M\u00eame historique administratif ;<\/li>\n<li>M\u00eame immatriculation luxembourgeoise ;<\/li>\n<li>M\u00eame admission \u00e0 la circulation au sein de l&rsquo;Union europ\u00e9enne.<\/li>\n<\/ul>\n\n<p><strong>Le v\u00e9hicule n&rsquo;a jamais \u00e9t\u00e9 d\u00e9clar\u00e9 dangereux.<\/strong><\/p>\n\n<p><strong>Il n&rsquo;a jamais fait l&rsquo;objet d&rsquo;une interdiction de circulation.<\/strong><\/p>\n\n<p><strong>Ses contr\u00f4les techniques successifs ont confirm\u00e9 son aptitude \u00e0 circuler.<\/strong><\/p>\n\n<h3>Une question demeure<\/h3>\n\n<p><strong>Comment un v\u00e9hicule admis \u00e0 la circulation au Luxembourg, utilis\u00e9 en France pendant plus de dix ans et n&rsquo;ayant jamais pr\u00e9sent\u00e9 le moindre probl\u00e8me de s\u00e9curit\u00e9 peut-il soudainement devenir probl\u00e9matique lorsqu&rsquo;un citoyen fran\u00e7ais demande son immatriculation ?<\/strong><\/p>\n\n<blockquote>\n<p style=\"text-align:center;font-size:22px;\"><strong><em>\u00ab Le v\u00e9hicule n&rsquo;a pas chang\u00e9.
